物业管理公司及物业管理人的发牌制度已正式实施
物业管理公司(物管公司)及物业管理人 (物管人)的发牌制度(发牌制度)已於2020年8月1日起正式实施。发牌制度旨在推动香港物管业朝向优质化及专业化发展,为市民提供优质及专业的物管服务。根据物业管理业监管局(监管局)公布,截至11月18日,监管局共发出超过1,000个物管公司及物管人牌照。监管局并已根据《物业管理服务条例》(第626章)(物管条例)的规定,刊宪公布发牌制度下的持牌人名单,以供市民查阅,有助增加业界运作的透明度,加强监察和规管的成效。此外网上登记册已於监管局网页内公布,包括物管公司牌照丶物管人牌照,以及临时物管人牌照的名单,并会不时更新有关资料,市民亦可亲身到监管局办事处查阅实体登记册。
监管局主席谢伟铨呼吁物管公司及物管人员早日申领牌照,为给予业界充足时间适应,在发牌制度实施日起设有3年的过渡期。在过渡期间,物管公司及物管人可选择,但不规定必须申领牌照。未能符合发牌制度下学历/专业资格要求但具指明物管经验的物管人,可於过渡期内申领临时牌照,然後修读监管局指明的课程。完成课程後即可在毋须符合相关学历/专业资格规定的情况下,申领正式物管人牌照。现时已有4 间大专院校获监管局委托承办监管局指明的课程。申领物管公司/物管人牌照的手续简便,申请人可透过监管局网站 www.pmsa.org.hk 进行申请。
Licensing Regime for Property Management Companies and Property Management Practitioners Has Come into Operation
The Licensing Regime for Property Management Companies (PMCs) and Property Management Practitioners (PMPs) (Licensing Regime) commenced with effect on 1 August 2020. The Licensing Regime aims to enhance the quality and professionalism of the property management industry, with a view to providing quality and professional property management services to the community. The Property Management Services Authority (PMSA) announced that as on 18 November, over 1,000 licences for PMCs and PMPs have been issued. In accordance with the requirement stipulated in the Property Management Services Ordinance (Cap. 626) (PMSO), the PMSA has published in the Gazette the list of licensees under the licensing regime for public inspection. Publication of the list of licensees in the Gazette can increase the transparency of operation in the industry, and strengthen monitoring and regulatory effect. Moreover, the online registers including the latest information about licensed PMCs, PMPs and provisional PMPs are now available at PMSA's webpage and will be updated from time to time. The physical registers are also available for inspection at the PMSA office.
Mr Tony TSE, the PMSA Chairperson appealed to PMCs and PMPs to apply for licence as soon as possible. To allow the industry sufficient time to adapt, there will be a three-year transitional period after the Licensing Regime comes into operation. During the transitional period, PMCs and PMPs may choose, but are not required, to be licensed. PMPs who do not meet the licensing requirements of academic and/or professional qualifications but possess the specified work experience may apply for provisional PMP licence within the transitional period. By attending a PMSA Specified Course and upon completion of the study, a PMP may apply for a formal licence without having to comply with the requirements of academic and/or professional qualifications. Currently there are 4 educational institutions appointed to provide PMSA Specified Courses. Application procedures for PMC / PMP licence are simple. Applicants can apply for licence via the PMSA website at www.pmsa.org.hk.
