主席的話

各位會員朋友:

本人感到十分榮幸能擔任英國特許房屋經理學會亞太分會(下稱"亞太分會")主席一職。由於歷屆主席都對亞太分會貢獻良多,深感責任重大,因此只能懷着戰戰兢兢的心情竭盡所能,以謙虛務實的態度繼續貫徹亞太分會的宗旨,期望能透過會員的共同努力,與時並進,攜手向前。

承先啟後,不忘初心。亞太分會一直致力促進及結合房管的藝術與最新科技融合,不斷為會員提供培訓及交流的機會。更時刻提醒會員除要注重行業之專業服務外亦要緊記房管專業的行為操守。多年來亞太分會舉辦過無數大型研討會、專題演講、論壇、技術培訓、考察團,以提升會員的專業知識,並且透過不同形式的交流活動回饋社群。

過去的一年可說是充滿挑戰的一年,因為新冠肺炎大流行,全球經歷前所未有的災難性洗禮,各行各業都受到不同程度的影響,有政府或機構的服務停辦,部份行業亦須安排員工在家工作,減少外出。然而物業管理從業員在疫情期間一律照常上班謹守崗位,除需要繼續提供正常服務外,亦要兼顧清潔消毒工作及制定一系列防疫抗疫措施和緊急應變程序,工作量有增無減。本人藉此機會代表亞太分會衷心感謝各前線物業管理從業員在疫情期間盡心盡責,彰顯物業管理行業的專業服務精神。

此外,亞太分會在推動物業管理公司及物業管理人發牌制度的立法工作上不遺餘力。而《物業管理服務條例》附屬法例亦已於2020年8月1日起正式生效。在清晰的發牌制度指引下,從業員可朝着認可資歷準則加以進修,並在取得相關學歷及物管經驗後正式申領牌照。條例大大提升物業管理行業的專業認受性,故亞太分會鼓勵會員在三年過渡期內盡早向監管局提交牌照申請。

雖然新冠肺炎疫情已開始受控,但預計經濟環境仍需要一段長時間才能全面復甦。因此各會員仍需繼續努力,在逆境中自強不息,秉持專業態度及樂觀的心態,將管理服務質素及物業價值進一步提升。

Message from the Chairman

Dear Members,

I feel very honored to be the chairman of the Chartered Institute of Housing Asian Pacific Branch (hereinafter referred to as the "Asian Pacific Branch"). Since the previous chairmen contributed a lot to the Asian Pacific Branch, I deeply feel the heavy responsibility of being a chairman and will try my best efforts to implement the aims and missions carefully with a humble and pragmatic attitude, hoping the Asian Pacific Branch to keep pace with the times and achieve continuing advancement through the joint efforts of members.

We shall learn from the past experience and remain true to our original aspiration. The Asian Pacific Branch has been committed to promoting and integrating the art of housing management with the latest technology by providing members with ongoing trainings and communication opportunities. Members are reminded not only to pay attention to the professional services in the industry, but also to bear in mind the codes of conduct of a housing professional. Over the years, the Asian Pacific Branch has held numerous large-scale conventions, symposiums, forums, technical trainings and study tours to enhance the professional knowledge of members and contributed to the communities through different forms of gathering activities.

Undoubtedly, the past year was a year full of challenges. Owing to the pandemic of COVID-19, the world had experienced an unprecedented social and economic disruption, various sectors were affected adversely to a certain extent. The normal services of Government or some institutions were suspended. Some industries had to arrange employees to work from home in order to maintain social distancing. However, most practitioners of property management worked as usual during the pandemic. Apart from provision of normal services, they had to take care of additional cleaning and disinfection work, as well as formulating a series of preventive and contingency measures against the infectious disease. Their workload was greatly increased. On behalf of the Asian Pacific Branch, I would like to take this opportunity to sincerely thank all frontline property management practitioners for their dedication in demonstrating the professionalism of the property management industry during the pandemic.

In addition, the Asian Pacific Branch has devoted every effort to promote the legislative work of the licensing regime for both Property Management Companies and Property Management Practitioners. The subsidiary legislation of the "Property Management Services Ordinance" formally entered into force on August 1, 2020. Under the clear guidance of the regime, practitioners can further equip themselves to pursue recognized qualification and formally apply for a license after fulfilling relevant academic qualifications and property management experience. The regulation greatly enhances the professional recognition of the property management industry and the Asian Pacific Branch encourages members to submit license applications to the Property Management Services Authority as early as possible during the three-year transitional period.

Although the pandemic of COVID-19 is gradually under control, it is expected that full recovery of economy will still take a long time. Therefore, members are encouraged to make continuous efforts to strengthen themselves in adversity, to uphold a professional and optimistic attitude so as to further enhance the service quality and the property values.

「特許房屋經理學會有限公司」(簡稱"CIH Asia")的成立

CIH Asia 為英國特許房屋經理學會(簡稱"CIH")於香港設立的全資子公司。英國特許房屋經理學會亞太分會(簡稱"CIHAPB")目前在香港根據《社團條例》註冊,經審視亞太分會的角色、責任及現行法例後,CIH 決定成立 CIH Asia。

CIH Asia將負責CIHAPB的日常運營(包括會員服務、專業培訓及其他活動等)。 CIHAPB 的執行委員會成員,將由 CIH 任命為委員負責CIH Asia 的運營和服務。

自 2021 年 7 月 1 日起,所有會費或任何其他收入如培訓活動收入將支付給 CIH Asia,而CIHAPB持有的資產也將轉移至CIH Asia。

另為了遵守中國內地現行的法律及規章制度,CIH 現已在內地新設立了"深圳玄宇信息諮詢有限公司"(簡稱"玄宇公司"),玄宇公司將以"CIH 中國"的名義負責中國內地的CIH 日常運營事務。

Setting up of CIH Asia International Limited (CIH Asia)

CIH Asia, is a limited company formed in Hong Kong and a wholly owned subsidy of Chartered Institute of Housing (CIH). Chartered Institute of Housing Asian Pacific Branch (CIHAPB) is currently registered under the Societies Ordinance in Hong Kong. After reviewing the roles and liabilities etc. recently and with a view of complying with the current legislations and regulations, CIH has decided to set up CIH Asia.

CIH Asia will be responsible for the day-to-day operations of CIHAPB (including membership services, professional training and other activities etc.). The EC of CIHAPB will be appointed by CIH to advise the operations and the services of CIH Asia.

With effect from 1 July 2021, all membership fees or any other incomes such as training activities will then be payable to CIH Asia. All the revenues or assets currently held by CIHAPB will also be transferred to CIH Asia.

Moreover, with a view of complying with the current legislations and regulations in Mainland China, CIH has set up a new company named as Shenzhen Xuan Yu Information Consulting Company ("Xuan Yu") which will be responsible for the membership services in Mainland China under the brand name of CIH China.

物業管理業監管局制訂《物業管理公司處理代客戶收取的款項》及 《物業管理公司就其委任的結束須履行的責任》《操守守則》及 相關《良好作業指南》

物業管理業監管局(監管局)公布根據《物業管理服務條例》(第626章)(《物管條例》)第5(1)條制訂的兩份《操守守則》的草擬本,包括《物業管理公司處理代客戶收取的款項》守則及《物業管理公司就其委任的結束須履行的責任》守則。為了讓物業管理(物管)公司及物管人牌照持有人更有效及專業地依循《操守守則》內所列明的各項指引,監管局同時制訂相關的《良好作業指南》供牌照持有人依循行事。以上兩項《操守守則》已於5月7日刊憲生效。

監管局早前已發出物管界的《一般操守守則》、《物業管理公司處理投訴的機制》及《物業管理公司須有效控制物業管理業務》的操守守則及相關指南。

監管局主席謝偉銓表示:「有關《操守守則》及《良好作業指南》為物管公司及從業員在處理代其客戶收取有關物業管理的款項及物管公司於結束委任時的交接工作方面提供了實務指引,目的是加強物管服務的財務管理及改善離任與接任物管公司的交接工作,使業界能更有效地為公眾提供優質的物管服務。

此外,物管業發牌制度自2020年8月實施後,業界反應正面,截至5月18日,監管局已共發出超過3,000個物業管理人及物管公司牌照。」

PMSA formulates the Codes of Conduct entitled "Handling Moneys Received on Behalf of Clients by Property Management Companies" and "Obligations of Property Management Companies Regarding the Ending of their Appointment" and the Relevant Best Practice Guides

The Property Management Services Authority (PMSA) announced that pursurant to Section 5(1) of the Property Management Services Ordinance (PMSO), two draft Codes of Conduct entitled "Handling Moneys Received on Behalf of Clients by Property Management Companies" and "Obligations of Property Management Companies Regarding the Ending of their Appointment" respectively have been prepared. In order to allow property management company (PMC) and property management practitioner (PMP) licensees to follow the guidelines set out in the codes in an effective and professional manner, the PMSA has also prepared relevant Best Practice Guides for the licensees to follow suit. These two Codes of Conduct has been gazetted and take effect on 7 May 2021.

The PMSA has issued the Codes of Conduct in relation to "General Code of Conduct", "Complaint Handling Mechanism of Property Management Companies", and "Effective Control over Property Management Business by Property Management Companies" as well as related guides for the property management sector.

Mr Tony TSE, the PMSA Chairperson said, "The Codes of Conduct and Best Practice Guides provide PMCs and PMPs with practical guidelines in handling the collection of PM related moneys on behalf of their clients, as well as the handover work of a PMC at the end of its appointment. The purpose is to strengthen the PMCs' financial management in respect of their PM services and to improve the handover work between the outgoing and the succeeding PMCs, so that the industry is able to provide high-quality PM services to the public more effectively. I hereby appeal to the industry to actively support and follow the codes and guidelines, and work together to promote the industry's development for enhancement of quality and professionalism."

Furthermore, since the implementation of the licensing regime from August last year, as of 18 May 2021, the PMSA has already issued over 3,000 PMP and PMC licences.
